Welcome to Pickadspace! These Terms and Conditions (“Terms”) govern your access to and use of the Pickadspace platform, including its web and mobile applications. By accessing or using Pickadspace, you agree to be bound by these Terms, which constitute a legal agreement between you and Capsdata Technologies Private Limited, the company that owns and operates the Pickadspace platform.

  • Eligibility
      1. Capsdata Technologies Pvt. Ltd. reserves the right to approve or reject an establishment based on location and footfall analysis.
      2. Only individuals aged 18 years or older are eligible to advertise or host digital signage units.
  • User Responsibilities
      1. Establishment owners must maintain the signage unit in good condition and ensure its cleanliness and protection.
      2. Establishment owners are responsible for securing the unit against theft or damage. In case of theft, a police complaint must be filed, and full cooperation with the investigation is required.
      3. Units must remain within a few feet of their original placement. Any significant movement beyond this will be considered a deviation from the intended installation. In such cases, we may request the establishment owner to reposition the unit back to its designated location. Repeated violations may lead to account cancellation. Please note that each unit includes a GPS tracker to monitor its current location for traceability and compliance.
      4. If the unit is placed in a manner that obstructs the people-counting functionality, the establishment owner will not receive payments for public ads.
      5. Tampering, hacking, or unauthorized access to the signage unit is strictly prohibited. Pickadspace reserves the right to investigate and take legal action in case of any violations.
  • Ad Content Guidelines & Review Process
      1. All ads are manually reviewed before approval.
      2. Pickadspace reserves the right to reject any ad content deemed inappropriate or in violation of guidelines.
      3. To ensure content appropriateness and public safety, the Pickadspace platform enforces strict restrictions on advertisements that fall into sensitive or harmful categories. Content promoting hate speech, terrorism, violence, or war crimes is strictly prohibited. Similarly, advertisements containing pornographic material, nudity, escort services, or other sexually explicit content are not allowed. Ads promoting drugs, alcohol, tobacco products, gambling, or betting services are also barred. While the platform supports democratic participation, political advertisements—such as those related to elections, parties, or candidates—are only permitted if they comply with the Election Commission of India’s guidelines and the platform moderation team. Religious content that promotes intolerance or social division is strictly disallowed. Furthermore, any advertisements that spread disinformation, promote self-harm, or encourage dangerous trends are explicitly blocked/not approved. These measures are put in place to uphold ethical advertising standards, protect public trust, and preserve the neutrality and credibility of the establishment.
      4. Advertisers bear sole legal responsibility for the content of their ads. Capsdata Technologies and establishment owners hold no liability for damages caused by ads.
      5. Establishments have the option to block specific ads or advertisers via their mobile app.
  • Revenue Sharing & Payments
      1. Establishments receive payments on a monthly basis, provided they have met the necessary criteria as outlined in their agreement and platform policies.
      2. If a signage unit is provided for free, we may withhold its value from the ad revenue generated by that unit until the full cost is recovered. Only earnings exceeding the withheld amount will be credited to the establishment. Whether this withholding applies will be communicated clearly and documented in the agreement signed with the establishment.
      3. The minimum payout threshold is 5000 INR. If earnings do not reach this amount, they are carried over to the next month.
      4. Establishments receive digital receipts for payments, and reports are accessible via the web and mobile apps.
  • Ad Credits and Refunds
      1. Funds added by advertisers for running ad campaigns will be converted into Ad Credits, which can be used exclusively on the Pickadspace platform to publish advertisements.
      2. Applicable GST will be charged on the amount added. The final billing amount will reflect the tax component as per prevailing tax laws.
      3. Ad Credits are non-transferable and are strictly tied to the advertiser’s registered business account. They cannot be moved or reassigned to another business entity or user account.
      4. GST and PAN details provided at the time of transaction will be used for all legal and compliance documentation. If these details are updated at a later date, they will only apply to future transactions. Previously completed transactions will continue to reflect the originally submitted GST and PAN and cannot be altered retroactively.
      5. Once funds are added and converted into Ad Credits, they are non-refundable and non-withdrawable under any circumstances.
      6. The minimum top-up amount is ₹100. Advertisers can load any amount based on their campaign needs, up to a maximum of ₹10,00,000 (INR) per transaction. For transactions exceeding this limit, please reach out to our sales team for assistance.
      7. In the event of a failed transaction originating from the Pickadspace app, the debited amount will be automatically refunded to the source account within 7 business days. For failures that occur at the payment gateway level, the refund timeline will be subject to the policies and processing timelines of the respective payment gateway or financial institution.
      8. Refunds will be considered only if Pickadspace is unable to run the campaign due to a verified technical issue on our platform. In such cases, the refund process may take between 10 to 30 business days after successful verification.

  • Dynamic Pricing & Viewership Data
      1. Viewership is calculated using an AI-based camera, with data processing performed at the edge.
      2. No image or video data of viewers is stored; only numeric analytics are transmitted to the cloud.
      3. Disputes regarding viewership accuracy can be submitted to grievance@pickadspace.com for review and investigation by our team. Please note that viewership data is generated using advanced AI-based estimation techniques designed to enhance platform insights and overall campaign confidence. While we strive to maintain high accuracy, like any AI-driven system, occasional discrepancies may occur due to environmental or technical factors. These analytics are intended to provide indicative insights rather than official verification. Our internal systems actively monitor for anomalies, and our team continuously works to improve the precision of our detection models. However, no guarantees or assurances can be made regarding the absolute accuracy of this data, and refunds or adjustments will not be provided based on viewership estimates alone.
      4. No minimum viewership guarantees are provided for advertisers, and no refunds will be issued for ads not reaching a specific viewership threshold.
  • Termination of Service
      1. Pickadspace may terminate services for establishments attempting to tamper with the signage unit or manipulate viewership data.
      2. Advertisers who repeatedly upload inappropriate ads may be permanently banned.
      3. Users cannot delete their accounts due to legal data retention requirements.
      4. Capsdata Technologies Pvt. Ltd. reserves the right to terminate the agreement at any time and reclaim the installed devices if the operation is deemed consistently unprofitable over a sustained period.
  • Liability & Legal Compliance
    1. Pickadspace is not liable for losses arising from inaccuracies in AI-based viewership data or disruptions in ad delivery due to technical issues.
    2. Advertisers are solely responsible for ensuring their ads comply with legal and regulatory requirements.
    3. All legal disputes arising out of or in connection with the use of the Pickadspace platform shall be subject to the exclusive jurisdiction of the courts located in Ernakulam, Kerala, and governed by the laws of the Republic of India.
